1. Our Copyright Philosophy

Swing Monkey Arcade is built by developers who understand the blood, sweat, and creativity required to produce video games. We champion independent creators and studios. All game titles, trademarks, and characters appearing on our site remain the sole intellectual property of their original copyright owners.

It is our strict policy to respond promptly to clear, formal notices of alleged copyright infringement in full accordance with the United States Digital Millennium Copyright Act ("DMCA") and international copyright treaties.

2. Notice & Takedown Procedure

Upon receipt of a valid and complete notification of claimed copyright infringement complying with 17 U.S.C. § 512(c)(3), our legal team will:

1. Immediately review and verify the submission within 24 to 48 business hours.
2. Expeditiously remove, disable, or de-index the allegedly infringing game iframe or asset from public access.
3. Notify the game submitter or distributor of the takedown action and forward the takedown notice in accordance with legal requirements.

3. Required Elements of a Valid DMCA Notice

To enable our compliance officer to act quickly, please ensure your written notification includes all of the following statutory elements:

• Physical or Electronic Signature: An authorized electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or a representative list if multiple works are involved.
• Identification of Infringing URL: The exact web URL(s) on https://swing-monkey.github.io/ where the allegedly infringing material is located (e.g., https://swing-monkey.github.io/action/game-name.html).
• Your Contact Information: Your full legal name, company name (if applicable), mailing address, telephone number, and active email address.
• Good Faith Statement: A statement that you have a "good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
• Perjury Statement: A statement that "the information in this notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

5. Counter-Notification Procedure

If you are a game developer who believes your content was removed or disabled by mistake or misidentification, you may submit a formal counter-notification under 17 U.S.C. § 512(g)(3).

Your counter-notification must be in writing and contain your physical or electronic signature, identification of the disabled material, a statement under penalty of perjury of good faith belief, and your consent to federal court jurisdiction. Upon receipt of a valid counter-notice, we will forward it to the original complaining party.

In compliance with Section 512(i)(1)(A) of the DMCA, Swing Monkey Arcade maintains an uncompromising policy that provides for the prompt termination, ban, and refusal of future submissions from any developer, submitter, or distributor identified as a repeat copyright infringer.
